Terms & Conditions

These Terms & Conditions (“Terms”) govern the services provided by FlowmaticAI, operated by Subham Paul from Kolkata, India (“FlowmaticAI”, “we”, “us”), to you, the client (“Client”, “you”). These Terms are effective from 04 October 2026.

1. Acceptance of Terms

By engaging FlowmaticAI services, accepting a proposal, or making any payment, you agree to these Terms in full. If a signed proposal or agreement contains terms that differ from these, the signed document will apply for that engagement.

2. Services Provided

  • AI automation systems, WhatsApp automation, CRM dashboards, and lead management.
  • Related services such as AI chat and voice assistants, website lead capture, and Meta ads setup, as described in your proposal.
  • Services are provided for Indian and international businesses.

The exact scope, deliverables and timelines for each engagement are set out in the proposal agreed with you.

3. Payment Terms

  • 50% upfront payment is required before any work commences.
  • The remaining 50% is due before final delivery.
  • India pricing: a one-time setup fee plus a monthly retainer, as agreed in the proposal.
  • No refunds after work has commenced (see our Refund Policy).
  • Third-party costs (such as Meta ad spend, WhatsApp conversation charges, phone numbers and AI usage) are paid by the Client unless the proposal says otherwise.

4. Client Responsibilities

  • Provide accurate business information.
  • Respond to feedback requests within agreed timelines.
  • Provide access to required platforms (Meta Business, WhatsApp Business, etc.).
  • Ensure your use of the systems we build complies with applicable laws and platform policies, including obtaining consent before messaging your own customers.

Delays caused by missing information, access or feedback may extend delivery timelines.

5. Intellectual Property

  • All code and systems become client property upon full payment.
  • FlowmaticAI retains the right to reference the project as a portfolio piece or case study.
  • The Client may request in writing to opt out of portfolio use by emailing connect@flowmaticai.tech.

6. Limitation of Liability

  • FlowmaticAI is not liable for Meta ad spend results or lead quality.
  • FlowmaticAI is not liable for downtime of third-party platforms (Meta, WhatsApp, Twilio, or AI providers).
  • Maximum liability is limited to the fees paid to FlowmaticAI in the current month.
  • FlowmaticAI is not liable for any indirect or consequential loss, including loss of profit, revenue or business opportunity.

7. Termination

  • Either party may terminate with 7 days written notice to connect@flowmaticai.tech.
  • Work completed to date will be invoiced and is payable.

8. Governing Law

  • These Terms are governed by the laws of India.
  • Jurisdiction: courts of Kolkata, West Bengal, India.
